Please read these Terms of Service carefully, as they contain important information about your legal rights, remedies, and obligations. You accept these Terms of Service and agree to abide by them by accessing or using Veekle's platform.
Additionally, you consent to the arbitration clause and class action waiver by accepting these Terms of Service. Please read it carefully.

These Terms of Service ("Terms") constitute a legally binding agreement ("Agreement") between you and Veekle (as defined below) governing your access to and use of the Veekle website, including any subdomains thereof, and any other websites through which Veekle makes its services available (collectively, "Site") -- our mobile, tablet and other smart device applications -- and application program interfaces (collectively, "Application") and all associated services (collectively, "Veekle Services"). The Site, Application, and Veekle Services are collectively referred to as the “Veekle Platform.”
When these Terms mention “Veekle,” “we,” “us,” or “our,” it refers to the Veekle you are contracting with determined by either your express selection or by Veekle’s assessment of your residence using various data attributes associated with your Veekle account.
Our collection and use of personal information connected with your access to and using the Veekle Platform is in our Privacy Policy.
Scope of Veekle Services
1.1 The Veekle Platform is an online marketplace that enables registered Travelers (“Travelers”) and registered Owners (“Owners”) and the services they offer as “owner Services” to publish such owner Services (Car Listings) on the Veekle Platform and to communicate and transact directly with Travelers seeking to book such owner Services.
1.2 As the provider of the Veekle Platform, Veekle does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Listings or owner Services, nor is Veekle an organizer or retailer of travel packages. Owners alone are responsible for their Listings and owner Services. When Travelers make or accept a booking, they are entering into a contract directly with each other. Veekle is not and does not become a party to or another participant in any contractual relationship between Travelers. Veekle is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms.
1.3 Veekle has no control over or guarantees (i) the existence, quality, safety, suitability, or legality of any Listings or owner Services; (ii) the truth or accuracy of any Listing descriptions, Ratings, Reviews, or other Member Content (as defined below); or (iii) the performance or behavior of any Member or third party. We may help settle disputes, but we do not own or control these things. Veekle does not endorse any member, listing, or owner services. Any reference to a member being "verified" (or similar language) only indicates that the member has completed a relevant verification or identification process and nothing else. Any such description is not an endorsement, certification, or guarantee by Veekle about any Member, including the Member's identity or background or whether the Member is trustworthy, safe, or suitable. It would be best if you always exercised due diligence and care when deciding whether to use the car or other owner services, accept a booking request from a traveler, or communicate and interact with other travelers, whether online or in person. Verified images (as defined below) are intended only to indicate a photographic representation of a listing when the photograph was taken and are therefore not an endorsement by Veekle of any owner or listing.
1.4 If you choose to use the Veekle Platform as an owner, your relationship with Veekle is limited to being an independent, third-party contractor, and not an employee, agent, joint venturer, or partner of Veekle for any reason, and you act exclusively on your behalf and for your benefit, not on behalf or for the benefit of Veekle. Veekle does not, and shall not, be deemed to direct or control you generally or in your performance under these Terms specifically, including in connection with your provision of the owner services. You acknowledge and agree that you have complete discretion whether to list owner services or otherwise engage in other business or employment activities.
1.5 To promote the Veekle Platform and increase exposure to potential travelers, listings and other member content may be displayed on other websites, applications, emails, and online and offline advertisements. To assist travelers who speak different languages, listings and other member content may be translated, in whole or in part, into other languages. Veekle cannot guarantee the accuracy or quality of such translations, and travelers are responsible for reviewing and verifying the accuracy of such translations. The Veekle Platform may contain translations powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and implied warranties for merchantability, fitness for a particular purpose, and non-infringement.
1.6 The Veekle Platform may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services may be subject to different terms and conditions and privacy practices. Veekle is not responsible or liable for the availability or accuracy of such Third-Party Services or the content, products, or services available from such Third-Party Services. Links to such Third-Party Services are not an endorsement by Veekle of such Third-Party Services.
1.7 Due to the nature of the Internet, Veekle cannot guarantee the continuous and uninterrupted availability and accessibility of the Veekle Platform. Veekle may restrict the availability of the Veekle Platform or certain areas or features thereof. Suppose this is necessary given capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the Veekle Platform. Veekle may improve, enhance and modify the Veekle Platform and introduce new Veekle Services from time to time.
Modification of Terms
Veekle reserves the right to modify these Terms at any time following this provision. If we make changes to these Terms, we will post the revised Terms on the Veekle Platform and update the “Last Updated” date at the top of the Terms. We will also provide you with notice of the modifications by email at least thirty (30) days before the date they become effective. If you disagree with the revised Terms, you may immediately terminate this Agreement. We will inform you about your right to terminate the Agreement in a notification email. If you do not end your Agreement before the date the revised Terms become effective, your continued access to or use of the Veekle Platform will constitute acceptance of the revised Terms.
Eligibility, Using the Veekle Platform, Member Verification
3.1 You must be at least 23 - 75 years old and able to enter into legally binding contracts to access and use the Veekle Platform or register a Veekle Account. By accessing or using the Veekle Platform, you represent and warrant that you are 23 or older and have the legal capacity and authority to enter into a contract.
3.2 Veekle may make access to and use of the Veekle Platform, or certain areas or features of the Veekle Platform, subject to certain conditions or requirements, such as completing a verification process, meeting specific quality or eligibility criteria, meeting Ratings or Reviews thresholds, or a Member’s booking and cancellation history.
3.3 User verification on the Internet is difficult, and we do not assume responsibility for confirming any Member’s identity. However, all users are required to submit a license verification check, which Jumio facilitates. Veekle also conducts policy report checks on Owners before vehicle listing is public.
3.4 The access to or use of certain areas and features of the Veekle Platform may be subject to separate policies, standards or guidelines or require you to accept additional Terms and Conditions. Suppose there is a conflict between these Terms and the terms and conditions applicable to a specific area or feature of the Veekle Platform. The latter terms and conditions will take precedence concerning your access to or use of that area or feature unless specified otherwise.
3.5 If you access or download the Application from the App Store, you agree to the Licensed Application End User License Agreement. Some areas of the Veekle Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.
Account Registration
4.1 You must register an account ("Veekle Account") to access and use certain features of the Veekle Platform, such as publishing or booking a Listing. Suppose you are registering a Veekle Account for a company or other legal entity. In that case, you represent and warrant that you have the authority to legally bind that entity and grant us all permissions and licenses provided in these Terms.
4.2 You can register a Veekle Account using an email address and creating a password, or through your account with certain third-party social networking services, such as Facebook or Google ("SNS Account"). You can disable the connection between your Veekle Account and your SNS Account at any time by accessing the "Settings" section of the Veekle Platform.
4.3 You must provide accurate, current, and complete information during the registration process and keep your Veekle Account and public Veekle Account profile page information up to date at all times.
4.4 You may not register more than one (1) Veekle Account unless Veekle authorizes you to do so. You may not assign or otherwise transfer your Veekle Account to another party.
4.5 You are responsible for maintaining the confidentiality and security of your Veekle Account credentials and may not disclose them to any third party. You must immediately notify Veekle if you know or have any reason to suspect that your credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your Veekle Account. You are liable for all activities conducted through your Veekle Account unless you do not authorize such activities. You are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).
4.6 Veekle may enable features that allow you to authorize other Travelers or certain third parties to take specific actions that affect your Veekle Account. For example, we may allow eligible Travelers or certain third parties to book Listings on behalf of other Travelers. We may enable owners to add other individuals as Custodians to help manage their Listings. These features do not require you to share your credentials with anyone else. Veekle authorizes no third party to ask for your credentials, and you shall not request the credentials of another Member.
4.7 Deleting Account Instructions
Deleting your account is an irreversible action. Please proceed with caution. By selecting "YES" below, your request to delete your account will be submitted to our Admin representative through their email at "support@veekle.com". After a thorough review and acceptance by the admin, your account will be immediately terminated, and all associated data will be permanently lost.
Please be aware that you will no have access to any information or features within your account once this process is completed.
Content
5.1 Veekle may, at its sole discretion, enable Travelers to (i) create, upload, post, send, receive and store content, such as text, photos, audio, video, or other materials and information on or through the Veekle Platform ("Member Content") and (ii) access and view Member Content and any content that Veekle itself makes available on or through the Veekle Platform, including proprietary Veekle content and any content licensed or authorized for use by or through Veekle from a third party ("Veekle Content" and together with Member Content, "Collective Content").
5.2 Subject to your compliance with these Terms, Veekle grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your device(s) and (ii) access and view any Collective Content made available on or through the Veekle Platform and accessible to you, solely for your personal and non-commercial use.
Fees
6.1 Veekle may charge fees to Owners ("owner Fees") and Travelers ("Traveler Fees") (collectively, "Fees") in consideration for the use of the Veekle Platform.
6.2 Any applicable Fees (including any applicable Taxes) will be displayed to an owner or Traveler before publishing or booking a Listing. Veekle reserves the right to change the Fees at any time and will provide Travelers and Owners adequate notice of any fee changes before they become effective.
6.3 You are responsible for paying any fees that you owe to Veekle. Veekle Payments collect the applicable Fees (including any applicable taxes). Veekle Payments will deduct any owner Fees from the Listing Fee before remitting the payout to the Owner. Traveler Fees (called service fees) are included in the Total Fees collected by Veekle Payments, except as otherwise provided on the Veekle Platform, Service Fees are non-refundable.
Booking Vehicles
7.1 You understand that a confirmed booking of a Car (“Car Booking”) is a limited license granted to you by the Owner to enter, occupy and use the Car. During this time, the Owner (only where and to the extent permitted by applicable law) retains the right to re-enter the Car, per your agreement with the Owner.
7.2 Travelers can only rent vehicles for personal use. Cars rented for commercial purposes, organized racing, or stunting activity are prohibited.
7.3 Veekle vDollars
Veekle vDollars may be redeemed for eligible bookings via the Veekle Platform specified in the terms and conditions provided with the vDollars.
Booking Modifications, Cancellations, and Refunds
8.1 Owners and Travelers are responsible for any modifications to a booking they make via the Veekle Platform and agree to pay any Owner Fees or Traveler Fees and Taxes associated with such Booking Modifications.
8.2 Travelers can cancel a confirmed booking at any time according to Listing’s cancellation policy. Veekle Payments will refund the amount of the Total Fees due to the Traveler per such cancellation policy. Unless extenuating circumstances exist, any portion of the Total Fees due to the Owner under the applicable cancellation policy will be remitted to the Owner by Veekle Payments under the Payments Terms.
8.3 If an Owner cancels a confirmed booking, the Traveler will receive a full refund of the Total Fees for such booking within a commercially reasonable time of the cancellation. In some instances, Veekle may allow the Traveler to apply the refund to a new booking. Veekle Payments will credit the amount against the Traveler’s subsequent booking at the Traveler’s direction. Further, Veekle may publish an automated review on the Listing canceled by the Owner, indicating that a booking was canceled. Also, Veekle may (i) keep the calendar for the listing unavailable or blocked for the dates of the canceled booking and (ii) impose a cancellation fee, unless the Owner has a valid reason for canceling the booking according to Veekle’s Extenuating Circumstances Policy or has legitimate concerns about the Traveler’s behavior.
8.4 In certain circumstances, Veekle may decide, in its sole discretion, that it is necessary to cancel a confirmed booking and make appropriate refund and payout decisions. This action may be for reasons outlined in Veekle's Extenuating Circumstances Policy or (i) where Veekle believes in good faith while taking the legitimate interests of both parties into account, and this is necessary to avoid significant harm to Veekle, other Travelers, third parties or property or (ii) for any of the reasons set out in these Terms.
8.5 If a Traveler suffers a Travel Issue according to the Traveler Refund Policy, Veekle may determine, in its sole discretion, to refund the Traveler part or all of the Total Fees per the Traveler Refund Policy.
8.6 If, as an owner, your Traveler cancels a confirmed booking or Veekle decides that it is necessary to cancel a confirmed booking. Veekle issues a refund to the Traveler per the Traveler Refund Policy, Extenuating Circumstances Policy, or other applicable cancellation policy; you agree that in the event you have already been paid, Veekle Payments will be entitled to recover the amount of any such refund from you, including by subtracting such refund amount out from any future Payouts due to you.
8.7 Except as otherwise set out in these Terms, Travelers may use the Resolution Center to send or request money for refunds, additional owner Services, Co-owner Services, or Damage Claims related to bookings. You agree to pay all amounts sent through the Resolution Center in connection with your Veekle Account, and Veekle Payments will handle all such payments.
Insurance
9.1 All listed vehicles must be insured with our insurance provider for both primary and rental coverage. Owners and Travelers pay an insurance premium, which is displayed during the listing and booking process.
By registering and renting on our platform, you agree to rent a vehicle for personal use only. Vehicles rented for commercial purposes, organized racing, subleasing, or stunting activity are not covered.
Traveler further agrees to abide by all stipulated local and national regulations guiding the use and operation of the rented vehicle.
Damage to Vehicles, Disputes between Travelers
As a Traveler, you are responsible for leaving the Car (including any personal or other property located at the Car) in the condition it was in when you arrived. You are responsible for your acts and omissions and are also responsible for the acts and omissions of any individuals you invite to, or otherwise provide access to, the Car, excluding the Owner.
Travelers must report incidents that occur during a rental within 48 hours of the incident's occurrence. Suppose an incident is not reported within 48 hours of its occurrence; in that case, the traveler may forfeit the insurance coverage applicable to the trip and be solely responsible for the full cost of repairs and any loss or liability arising from the incident.
Ratings and Reviews
11.1 Within a specific time frame after completing a booking, Travelers and Owners can leave a public review (“Review”) and submit a star rating (“Rating”) about each other. Ratings or Reviews reflect the opinions of individual Travelers and do not reflect the opinion of Veekle. Ratings and Reviews are not verified by Veekle for accuracy and may be incorrect or misleading.
11.2 Travelers are prohibited from manipulating the Ratings and Reviews system in any manner, such as instructing a third party to write a positive or negative Review about another Member.
11.3 Ratings and Reviews are part of a Member’s public profile. They may also surface elsewhere on the Veekle Platform (such as the Listing page) with other relevant information such as the number of bookings, number of cancellations, average response time, and additional information.
Text Messaging
12.1 By using the platform, you understand and agree that Veekle and those acting on its behalf may send you text (SMS) messages (potentially including messages generated using an automatic telephone dialing system) at the phone number you provided us. These messages may include operational messages about your use of the platform, as well as marketing or other promotional messages. You will not be able to use the platform without agreeing to receive operational text messages. You may opt-out of receiving marketing or other promotional text messages at any time by sending an email to the appropriate email on the website and the app indicating that you no longer wish to receive marketing or other promotional texts along with the phone number of the mobile device receiving the messages, or by following any unsubscribe instructions in the text messages. You may continue to receive text messages for a short period while Veekle processes your request, and you may also receive text messages confirming the receipt of your opt-out request. If you do not want to receive operational text messages from Veekle, do not place orders through the platform. Your agreement to receive marketing texts is not a condition of any purchase or use of the platform. If you change or deactivate the phone number you provided to Veekle, you must update your account information to help prevent us from inadvertently communicating with anyone who acquires your old number. Standard data and message rates may apply for SMS and MMS alerts, whether you send or receive such messages. Please contact your Carrier for details.
